Hasan v Bristol City Council 2025 Council seek adjournment of proceedings to allow parties to use the council’s internal complaints procedure. Claimant did not oppose a stay but said no more than 6 weeks and for mediation which they had proposed in their letter of claim. They had also proposed a joint settlement meeting.
It was held that the council’s complaints procedure was not independent and that there was no equality of arms and did not allow for resolution of all matters in dispute including costs.
